Georgia Solar Power Free-Market Financing Act of 2015

Solar Power Free-Market Financing Act of 2015 is a state law which amended Article 1 of Chapter 3 of Title 46 of the Official Code of Georgia Annotated. This law regulates solar technology provision for retail electric customers—and also regulates the relationship between the electric service providers and retail electric customers. For example “no electric service provider shall prevent or otherwise interfere with the installation, operation, or financing of solar technology…” The law permits “free-market” third-party financing of rooftop solar installations, but caps residential generation at 10 kilowatts, and 125% of peak demand for commercial installations.

Defines Solar Energy Procurement Agreement – “Solar energy procurement agreement” means any agreement, lease, or other arrangement under which a solar financing agent finances the installation, operation, or both of solar technology in which the payments are based on the performance and output of the solar technology installed on the property”
