North Las Vegas Compensating Public Benefits for Waivers

North Las Vegas Code of Ordinances § 17.12.070(L) allows developers to apply for waivers to reduce setbacks, parking spaces, and open space requirements in exchange for meeting compensating public benefits that among other goals achieve the comprehensive master plan goals of open space protection, energy conservation, and improved park and recreational amenities.

1. For a dedication or set aside waiver request, developers can increase landscape area, enhance open space and pedestrian amenities, or demonstrate that at least 75% of the buildings comply with one of the following green building practices: (a) Energy Star Certification, (b) Southern Nevada Home Builders Green Initiative Certification, or (c) LEED-H Certification – additional levels of certification (silver through platinum) may be considered as additional compensating public benefit.
2. For a waiver request to change the number of off-street parking spaces required, developers can increase landscaping for vehicle use areas, increase the number of street trees and landscaped trees, pedestrian amenities, and bike spaces and lockers.
3. Other waiver request related to landscaping and trees can be approved by offsets related to increase in groundcover and other pedestrian amenities.
