This rule requires that a contracting agency that intends to enter into a public improvement contract spend at least 1.5% of the total contract price for the purpose of including appropriate green energy technology (including solar energy) as part of the construction, reconstruction, or major renovation of the public building.
The agency must make a written determination by entering information about its public building project into the ODOE 1.5% for Green Energy Technology database after it makes its final determination before the construction/renovation of the building commences. In addition, Oregon House Bill 3169 (2013), Section 2 provides that each contracting agency, in soliciting, awarding and administering public improvement contracts that are subject to ORS 279C.527, is subject to rules of the Oregon State Department of Energy, which includes requirements and specifications for: (1) Using particular green energy technologies in public improvements; (2) Determining the cost-effectiveness of green energy technologies; (3) Reporting requirements
